A CHARTER ORDINANCE EXEMPTING THE CITY OF HESSTON, KANSAS, FROM THE PROVISIONS OF K.S.A. 12-4112 AND PROVIDING SUBSTITUTE PROVISIONS ON THE SUBJECT OF MUNICIPAL COURT COSTS.
Section 1. The City of Hesston, Kansas, by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, elects to exempt itself from and make inapplicable to it K.S.A. 12-4112 and any amendments thereto; and to provide substitute provisions as hereinafter set forth. Such statutory section is applicable to the City of Hesston, Kansas, but is not applicable uniformly to all cities.
Section 2. The provisions of K.S.A. 12-4112 are hereby repealed.
Section 3. The costs shall be assessed against accused persons for the administration of justice in any municipal court case where the accused person is found guilty or where the accused person pleads guilty. The city council shall by ordinance specify the base amount on court costs for cases before the municipal court and for costs for various actions deemed necessary in said cases. Base court costs shall not be imposed for violation of any ordinance or resolution relating to unlawful parking. These charges shall be assessed in addition to and not in lieu of the fees and mileage of witnesses which may be assessed in accordance with K.S.A. 12-4411.
